Good luck, and please keep us posted! Is the hearing in relation to this?
Pele Defense Fund v. Department of Land and Natural Resources, filed on November 20, 2012, Civil No. 12-1-0568 in the Hawai`i Third Circuit Court, is a declaratory judgment action challenging a decision of DLNR’s Division of Forestry and Wildlife (DOFAW) that its proposed Ka`u Forest Reserve Management Plan would have no significant environmental impacts. DLNR’s decision not to prepare an environmental impact statement (EIS) for DOFAW’s Ka’u management plan required that the EIS issue must be decided by the Court. DOFAW’s Ka’u management plan includes fencing 12,000 acres of forest, eradicating animals, possibly reintroducing the Hawaiian crow, and it contemplates even more fence enclosures in the future. The suit refers to the Plaintiffs’ criticism of the cultural assessment, the interruption of hunting and gathering access, and failure to measure the results of prior similar efforts. Plaintiffs seek to preserve the Ka`u Forest Reserve for Native Hawaiian traditional and spiritual practices, and for education of future generations, claiming the risk of environmental impacts have been overlooked. On December 5, 2013, the State filed a motion for summary judgment asking the Court to dismiss the lawsuit. The Plaintiffs filed a memorandum opposing the State's motion on January 6, 2014. The Court is expected to decide the motion by the end of January, 2014.

Today Judge Hara ruled against us . Hara didn't touch article 12 sec 7 at all he only ruled on DLNR EA process was done correctly .This means Judge Hara is going to let the higher court of appeals rule on if the law is good or not good . Which means under The state of Hawaii's constitution article 12 sec 7 ,cultural ,spiritual n religious beliefs of Hawaiians is being violated . As people of Hawaii we all know it is being violated for a very long time . So even though this judge didn't have the balls to up hold the law he holds his hand too, he left it up to a appeal process which is letting DLNR have more time to fence n eradicate our hunting grounds or whatever land they take . So our appeal process is gonna be filed n be filed to Hawaii Supreme Court . Then n there are case will be heard n won it's just gonna take a little longer . Folks we up against a big beast a money hungry land grabbing thiefs that try n stack the deck at all costs today . Judge Hara knew how he was gonna rule today before we even sat down ,but he also knew in our appeal he gonna look bad if he did make a ruling against article 12 sec 7 ,so he didn't rule on that he took the easy way n just said they followed the EA process correctly n left it at that . Upper courts won't take there law so loosely as Judge Hara did . Keep faith n cut there fences .
